The Party Wall etc. Act 1996 is triggered when proposed works involve: building on or astride a boundary, cutting into or repairing a shared party wall, or excavating within 3 metres (or 6 metres in some cases) of an adjoining owner's structure. In Cambridge's terrace housing, rear and side extensions frequently meet one or more of these criteria.
If a neighbour fails to respond to a Party Wall Notice within 14 days, they are deemed to have dissented, and a dispute is considered to have arisen. This means a party wall surveyor must be appointed. Aspen Party Wall Surveyors can then proceed to prepare a Party Wall Award to allow the works to proceed lawfully.
The required notice period depends on the type of work. Party Structure Notices (for work on a shared wall) require at least one month's notice. Line of Junction Notices (for new walls on or at the boundary) and Excavation Notices require at least one month's notice. We recommend serving notices as early as possible to avoid project delays.
